In most states, including California, any actor in a crime, in which
others died, be they victims or perps, can be charged with murder.

The theory being that if they had not been a part of the crime, no one
would have died.

Drivers of getaway cars are routinely charged with murder if someone
in the bank (example) is killed, be it crook or citizen
