Default New EPA demands for homes built before 1978!

If you are not federally certified to work with lead based paint you cannot
touch ANY project larger than 6 sq ft indoors or 20 sq ft outside PERIOD!
No home owner can work on it if it disturbs any more than the above
dimensions! Rule goes into effect on April 22, 2010. The ONLY exception is
if you spend several hundred $$$$$$$$$$$$ to get your home certified lead
free by a certified contractor. With 28 days to go there are only 10
various certified contractors within 100 miles of my zip code. $300 for the
application, which takes 6 weeks for the efficient gov to rubber stamp the
application, $100 for the 8-hour class, plus travel and food expenses, plus
about $1,000 minimum for the required equipment. A simple, cost-effective,
timely option for home owners Nobrains and his henchmen are on the
loose to help destroy the US.

I don't know how accurate the above assessment is; I understand there is
a new mandate from EPA but I've not read it specifically.

IMO, if so, it's one of those that folks just simply should use the
power of numbers and silence and rebel by simply not paying any
attention to the Feds on their own places. They simply cannot
effectively enforce such silliness unless people do become sheeple.

Of course, use reasonable work habits, etc., ...

There's a point at which folks simply have to say "enough's enough and
we're _not_ taking it anymore...

Another example of right wing hysteria.

The law applies to "renovations performed for compensation." In other
words, contractors.

The annual fee for getting certifed is a measly $300.

The law requires that contractors provide homeowners with a brochure
from the EPA about the risks of leak. Then they must mask off the area
where they're working and clean up after themselves. That's pretty
much it.

So stop listening to radio talks shows that blow this out of
proportion. It's a fairly simple law that protects children and
requires minimal extra work by contractors. Basically makes them clean
up after themselves when digging into lead painted areas.

If anybody on the board cares about getting the facts instead of these
hysterical rants, all they have to do is go to EPA.gov. It's all
there.

unlicensed/unpernitted activity.
This is lead, not plutonium. These people need to get a grip on

Anyhow, to address your hysteria over the EPA rules:

1. It exempts homeowners.

2. It's an eight-hour class. BFD. Over 50,000 renovators have been
certified already and there are trainers offering classes all over the
US. So unless you've got a emergency project, it should be no big deal
to wait a little longer *if necessary* to get a certified renovator.
If it is an emergency, you and your buddies can legally DIY.

It is actually a big issue, and very few people seem to know about it -
especially contractors.

The short version is basically that as of Aprill 22, 2010, anyone who does
work for compensation who is working on a residentially property built
before 1978, and who either disturbs (scraps, sands, etc.) more than 6
square feet of paint on the interior or 20 square feet of paint on the
exterior, or does any demolition, or does any window replacements, must be a
certified lead renovator and must follow certain procedures etc. This
includes landlords who do their own work on residential properties that they
own and rent out.

If I can find the links to the actual law, I'll post them.

In the meantime, here is a link to 16 short videos about the new lead-based

The link is from the National Association of Realtors website.

Among the videos, there is one that is near the end that is particularly
interesting. It's the one entitled, "Is it possible to avoid this rule?"

It says that if a home was built after 1950, the is a very good chance that
the home has no lead-based paint in the interior. The reason is that most
paint manufacturers stopped producing lead-based interior paint beginning in
1950. In 1960, most paint manufacturers stopped manufacturing lead-based
exterior paint.

Yeah, that was the way I'd heard it, too.

Wonder if there's an exemption for working on 'new work' done on a
property dating from before 1978? e.g. if someone puts up a new wall* in
a 1960's house and a contractor later comes in to work solely on that
wall, do they still have to follow the lead rules - even when they know
the area they're working on post-dates the 1978 cut-off?

* or, taking that a step further, something like an add-on room or an
adjoined garage.

here :-) Maybe that's different, and anything in water passes through the
body, and the danger's just in airborne particles...

Some of my friends can still be stirred to tooth-grinding rage by Clinton
and Carter, so I'd guess it's at least half a century. No, I take that
back, I know people who still insist FDR would have declared The Socialist
States of America if he could have, so better make that a full century just
to be on the safe side.

If only it were that simple for a guy trying to make a living running
a sole proprietorship or small business. The faster road to
bankruptcy is to take your advice. Then you wind up with a neighbor
calling the EPA, they come out, shut you down, fine you, a hazardous
waste clean-up company gets called in, which you pay for, then the
homeowner sues you for project delays, etc.

Nonny, as I'm sure you must know, the official names of the 2 largest political
parties in the U.S. are the "Republican Party" and the "Democratic Party".

However, for their own reasons, many Republicans, including most of their
Congressional leaders, insist upon referring to Democrats as belonging to the
"Democrat" party. I'll never understand why those Republicans are so proud of
their desire to flaunt this erroneous moniker. I've never heard of a Democrat
refer to their major opposition party as the "Public" party or the "Repubican"
party or any other erroneous name.

No matter what happens in the years ahead, some extremists will
continue to blame Bush for anything bad. Even if Iraq turns out to be
a free and stable country, he will get no credit. Of course, had
Bush simply done nothing with saddam, these same people would be
blaming him for that too. The whole world knew Saddam had WMDs
because he used them on his own people and against Iran. British,
Israeli, and Russian intelligence believe he still had them. He was
still refusing full cooperation with the UN inspectors and ignoring
the agreement that ended the first Gulf War right up until the day of
the war.. Most of the lib Democrats made many speeches outlining that
they too believed he still had WMDs and WMD programs. I can only
imagine what the Bush haters would be saying had he let Saddam stay in
power and some attack later resulted using WMDs. Then they'd be
calling for Bush's impeachment. Hindsight is always 20-20.

I don't know how accurate the above assessment is; I understand there is
a new mandate from EPA but I've not read it specifically.

IMO, if so, it's one of those that folks just simply should use the
power of numbers and silence and rebel by simply not paying any
attention to the Feds on their own places. They simply cannot
effectively enforce such silliness unless people do become sheeple.

Of course, use reasonable work habits, etc., ...

There's a point at which folks simply have to say "enough's enough and
we're _not_ taking it anymore...


The problem, as evidenced by the last presidential election and the trash
that is coming out of the dumbocrat congress, is that this is not a law
passed by congress, but is a sidestepping of the Constitution by the EPA.
It carries the weight of law without being constitutionally enacted. They
are planning to do the same with Cap and Trade. What do you expect when
criminals are put in charge of so many government agencies?

i.e. Bush?

Sorry, it applies to HOME OWNERS ALSO! It is also NOT a law, but a new
regulation out of the EPA bypassing the constitutional process.


The annual fee for getting certifed is a measly $300.

The law requires that contractors provide homeowners with a brochure
from the EPA about the risks of leak. Then they must mask off the area
where they're working and clean up after themselves. That's pretty
much it.


They have to file the $300 application, take the $100 class and get the
roughly $1,000 worth of equipment necessary to comply with the new
regulations.

So stop listening to radio talks shows that blow this out of
proportion. It's a fairly simple law that protects children and
requires minimal extra work by contractors. Basically makes them clean
up after themselves when digging into lead painted areas.


I got this by calling the EPA directly!

If anybody on the board cares about getting the facts instead of these
hysterical rants, all they have to do is go to EPA.gov. It's all
there.

Yeah, that was the way I'd heard it, too.

Wonder if there's an exemption for working on 'new work' done on a
property dating from before 1978? e.g. if someone puts up a new wall* in
a 1960's house and a contractor later comes in to work solely on that
wall, do they still have to follow the lead rules - even when they know
the area they're working on post-dates the 1978 cut-off?

Among the videos, there is one that is near the end that is particularly
interesting. It's the one entitled, "Is it possible to avoid this rule?"

It says that if a home was built after 1950, the is a very good chance that
the home has no lead-based paint in the interior. The reason is that most
paint manufacturers stopped producing lead-based interior paint beginning in
1950. In 1960, most paint manufacturers stopped manufacturing lead-based
exterior paint.

Some of my friends can still be stirred to tooth-grinding rage by Clinton
and Carter, so I'd guess it's at least half a century. *No, I take that
back, I know people who still insist FDR would have declared The Socialist
States of America if he could have, so better make that a full century just
to be on the safe side.


I still blame Lincoln for ignoring states rights & plundering the
south, We wouldn't have the intrusive government we have today if he

through general, that has not led troops in combat. You can't BUY that kind
of experience!

Also, we need wars to keep recruitment up. Who would become a fire-fighter

opportunity to kill people and blow things up, who would become a soldier?
Heck, 85% of those who've served in Iraq or Afghanistan have re-enlisted at
the first opportunity. The remaining 15% were invalided out, retired, or
married harridans.

Very true. The only problem is that since WWII, we've lost them all.
Well, except for the invasions of Panama to arrest Noriaga and the
invasion of Granada for a reason I don't recall. Generally, we no
longer do well if the foe is bigger than 2% our size or if he is
determined.

The problem is not our fighting men, but our political leadership and
wimpy civilian culture. They betray the military every time.

If only it were that simple for a guy trying to make a living running
a sole proprietorship or small business. *The faster road to

homeowner sues you for project delays, etc.




Why would a neighbor know what you're doing? I always flout EPA
and other gov't rules on my projects. The projects get done in a
timely fashion without gov't interference. Win, win.
