Thanks It would be helpful if you could rephrase your question because it is very difficult to understand. It certainly looks as if you aren't talking about the English legal system. Are you discussing the American system? The term "discovery" is (unfortunately) obsolete in England and the word "disclosure" is used instead. The court doesn't screen items. It will normally allow the parties to produce and refer to all documents which are relevant to the matters in issue. If documents are alleged to be privileged the court can be asked to decide whether or not they are privileged.
