We had a discussion about this at work. Assume it is Feb 09, the new
President has been in office for a couple weeks. It is discovered that
he is NOT a Natural born citizen per the Constitution.
1. He refuses to resign because he was elected by the "people"
2. The Dem controlled congress refuses to issue Articles of
impeachment

What is the mechanism to remove him from office???
The only thing we could conclude is that it would end up in the
Supreme Court, but the Supremes, have no power other than to rule and
direct to a Federal level court to enforce the ruling.

Then a Federal court could order him removed from office.

Ah, Thomas hasn't "embraced" anything. What the Court is doing is discussing
whether to grant certiorari to a petitioner (retired NJ lawyer Leo Donofrio,
who lives a few doors down from my dry cleaner's and who one writer,
well-published and not your typical emotionally disturbed blogger, calls
"bat**** insane") who claims that Obama is not qualified to be president NOT
because he's not a US citizen, but because his *father* was not a US
citizen, and that Obama's loyalties are therefore "divided.". There's a new
twist, eh?

You may be interested in something else --- AFP may have skipped over this
point -- Donofrio also is challenging McCain's candidacy in the petition,
because he says McCain is not a "natural born citizen." Perhaps it was a
virgin birth.

The speculation is that the Court is either going to deny cert, which would
be the usual thing to do, or it's going to make a statement that will get
the dozen or so state supreme courts that Donofrio, Berg, and some other

hook.

Under no circumstances is Harry Reid in the line of succession for the
Presidency.

First in line, obviously, is the Vice President. Then the Speaker of the
House. Then the President pro tempore of the Senate -- who is Robert Byrd.
(Harry Reid is the majority leader.)

Note, too, that the Speaker of the House can succeed to the Presidency *only*
if the Vice Presidency is vacant at the time the President dies, resigns, or
is removed from office.

If Obama dies in office, Biden becomes President -- and then nominates someone
to become Vice President, subject to confirmation by the Senate. Unless that
person is Nancy Pelosi, she remains, as Speaker of the House, still two steps
away from the Oval Office.
