Default Wyoming welder, facing $16M in fines, beats EPA in battle over stock pond

"A Wyoming man threatened with $16 million in fines over the building
of a stock pond reached a settlement with the Environment Protection
Agency, allowing him to keep the pond without a federal permit or
hefty fine."

Git off my lawn.

"...Under the settlement, Johnson's pond will remain and he won't pay
any fines or concede any federal jurisdiction to regulate the pond.
And the government won't pursue any further enforcement actions based
on the pond's construction."

Looks like a man-made attractive nuisance that needs a fence.

Wait till some little kid wanders in there and drowns.
The bereaved family's lawyers will make the EPA look like a bunch of boy scouts.

I suspect they'll be hearing from their insurance company soon. Idiots!

Right, every water source should be fenced. Ponds, creeks, rivers, even
the oceans.

A good idea. But don't use a chainlink fence for the ocean. Use a
stockade fence so when the oceans rise there won't be a problem.

The article said the farm sprawled over 6 acres. 6 acres is not
much, not enough to sprawl imo.

Yah, I've never really understood why a *man-made* swimming pool must be fenced but a *natural* pond does not.

A natural pond usually has a smooth transition from shallow to deep, not so with a man made swimming pool. A child can usually crawl out of a natural pond. ^_^

Probably not. It is in a farm field so it is a good bet that the
acreage itself is already fenced.

That is personal experience as an EMT in a rural area and don't EVEN get
me started on things like retention ponds that don't need fences in most
areas.

Per Barney Fife:
Looks like a man-made attractive nuisance that needs a fence.

I have no clue as to the veracity of this, but when we were visiting
relatives in Germany, somebody explained the litigation environment
there to me by saying "If a 3-year-old child wanders into a neighbor's
yard and is torn to shreds by the neighbor's dog, some very hard
questions are asked..... Questions like 'Where were that child's parents
that it was wandering around unsupervised' and 'Why didn't the parents
teach that kid not to go into other peoples' yards?"

Like I said, I have no clue how well that lines up with reality in
Germany, but it would seem to explain the relative lack of fences
there... which greatly enhances the walkability of the place.

In a similar vein, I was visiting the other half of the family in
England and was walking the trails at a place called St Aldhelm's Head:
footpaths along cliffs hundreds of feet above the ocean with mostly not
a fence in sight. "Mostly" because slightly inland, I came a cross a
fenced-in cattle pasture with a sign that said, basically, "Don't cross
this fence because there are dangerous animals within - and if you get
gored, it's 100% on you."....

I wasn't referring to a man made pond. All the natural ponds and lakes I've seen have a fairly smooth transition unless there is a rock formation with a drop off. North of here is a huge man made lake called Smith Lake which is used for hydro power. That darn thing is 500+ feet deep in places. I spent a lot of time there in the 80's but haven't been back since then. The most dangerous thing about that lake and recreational area is alcohol. You're probably well aware of alcohol and water not mixing very well. ^_^

Jesus, Jose` and Maria. It's a stock pond to water animals. Tell the
class what neighborhood kid is getting near bulls, these days. Boar
hogs, or other animals kids are afraid of these days.

Here's my concern:

The text says: "...Johnson, a ... married father of four..."

The picture shows Johnson, his wife and *three* daughters.

I hope the fourth kid didn't drown in the pond.

Maybe the one child wasn't born yet or was out tendin' the animals at
the "stock pond".
