First, all rights have restrictions. That's what the "compelling state
interest" line in many court decisions is all about.

While it has been claimed, in a free republic there is no
"compelling state interest". This was made clear after the 1861
Lincoln debacle.

That must have been the Free Republic of Botswana. g How about this one:
Is there a compelling state interest to prohibit the distribution of
pornography to minors, or does that violate the distributor's right to free
speech?

It's the one that keeps
us from shouting "fire" in a crowded theater and claiming a 1st Amendment
right.

And if there is a fire in a crowded theatre?

No problemo. It's when there is no fire that there's a potential problem.

The 2nd has had exactly one positive Circuit Appeals Court ruling in

recent
years, and a "compelling state interest" was involved in that case. It

was a
guy who was under a restraining order for threatening his wife. So that
case, too, addressed limitations on the right, as the 5th Circuit Court

had
to remand the case or something like that.

More legalisms by a lawyer wannabe.

Oh? And how would you have decided the Emerson case?
http://laws.lp.findlaw.com/5th/9910331cr0.html

That's the Second Amendment cast being referred to. Would you have let
Emerson carry his gun around, after threatening to kill his wife? Do you
think the federal law prohibiting people who are under a restraining order
in divorce cases from carrying a gun, because it's been demonstrated that
they are dangerous and threatening to their spouse?

It's all pretty simple, right? The 5th Circuit Court of Appeals found for an
individual RKBA, but they reversed Emerson's acquittal by a lower court.
Maybe it's not so simple?
