Educating The World on The EFCA. Myth vs. Reality: The REALITY is the Employee Free Choice Act Helps American Workers and their Families. Despite the need for reform, critics of EFCA continue to misinform the public about the bill and hide the serious shortcomings of current labor law. Democrats are committed to setting the record straight and passing this important legislation on behalf of American workers and their families. MYTH: EFCA will prevent the use of secret-ballot elections. REALITY: EFCA does not strip workers of their right to choose a secret-ballot election to decide whether to select -- or not to select -- a union representative. EFCA simply gives workers the additional option of selecting a union representative by majority sign-up. Organizing For America begins with the passing of the Employee Free Choice Act. The Employee Free Choice Act is nothing new it only reestablishes the Joy Silk Doctrine of 1949 History In 1949, the NLRB's Joy Silk Doctrine established that "an employer could lawfully refuse to bargain with a union claiming representative status through possession of authorization cards only if he had a 'good faith doubt' as to the union's majority status.This policy was changed in 1966 with the ruling in Aaron Brothers, where "the Board made it clear that it had shifted the burden to the General Counsel to show bad faith and that an employer 'will not be held to have violated his bargaining obligation... simply because he refuses to rely upon cards. 'If passed, the proposed Employee Free Choice Act would return the NLRB policy to the Joy Silk Doctrine and allow employer challenges to card check elections only when illegal coercion or fraud is charged. In 1969, Chief Justice Earl Warren delivered the majority opinion for the U.S. Supreme Court that upheld the use of card check. Warren stated, "Almost from the inception of the Act, then, it was recognized that a union did not have to be certified as the winner of a Board election to invoke a bargaining obligation; it could establish majority status by other means... by showing convincing support, for instance, by a union-called strike or strike vote, or, as here, by possession of cards signed by a majority of the employees authorizing the union to represent them for collective bargaining purposes." The Supreme Court has consistently ruled in favor of card check, and Warren cited prior affirmations in NLRB v. Bradford Dyeing Assn., (1940); Franks Bros. Co. v. NLRB,[(1944); United Mine Workers v. The town and the union lost. The company is now building the new plant about 30 miles away and told the current employees that they should apply for jobs in the new NON-UNION plant. The union has been screaming that they cannot do that because "they have a contract". The thing is that the contract was declared non-enforceable because this is a NEW company, with a NEW plant in a NEW town. So now the union is trying to get other unions to stir up crap as well. One of the big ones was a bunch of stories about how the steel used was going to be erected using non-union labor. GREAT, and it will likely get built for LESS money, faster and without all of the "cost overruns" that always seem to be part of any union run job. -- Steve W. |

Look, you're a Bush supporter, a right winger, and a follower of republicans. That alone means you don't know anything about what you are talking about and therefore have not a shred of credibility. So why would anyone listen to your ill-informed and ignorant opinion? The answer is they wouldn't. It's like this, if Bush says something most everyone now thinks it's automatically wrong because he's proven to be such a Bozo. It's the same with you. If you say unions are bad then that automatically means they are a good thing. Too bad we can't send you back to Texas with Bush so both of you could never be heard from again. It was amazing how vocal the unions were during the auto bailout negotiations in saying they felt they should have no givebacks. Why do you think the American automakers are in such bad shape? Is it just a coincidence that the non union automakers are doing much better than their unionized counterparts? Unions had their place back before the days of OSHA and other federal laws governing employee pay, safety etc, but they dont anymore. The EMployee Free Choice Act (AKA Employee No Choice Act) is just another attempt to get more power for the unions, so they can more easily organize more facilities, making more money for them so they can take your money and fatten their wallets and contribute to political parties and legislation you may or may not approve of. (Such as gun control laws.) And the person that said this law will not change anythign is nonsense. The union can use home visits and other tatics to coherice people to sign cards. Once you sign a card and if you change your mind, good luck getting that card back you never will. Secret ballet elections are a right workers have in deciding to have or not to have a union. DOnt let the government (or anyone else) take away this right! |

Hawke Dunno about Bürste, but I'm not a Bush supporter, a right winger or a follower of Republicans, or follower of anybody for that matter. I have been a union member, though. If a company has degraded to the point where it needs a union to protect the workers, the best thing to do is to dissolve the company. Better that than bring in a union. The union will destroy the company anyway, but also the little remaining self respect of the workers. David |
