Homeowners: Always report the crime immediately!
CALLAWAY, Fla. -- Help, police, someone stole my pot!
A Panhandle couple is under arrest after notifying police Thursday that their quarter-pound stash of marijuana was stolen and that they needed the weed back, because they were going to later sell it. "They're America's dumbest criminals," said Lt. Ricky Ramie, head of the Bay County Sheriff's Office narcotics task force. Deputies arrested 18-year-old John Douglas Sheetz and 17-year-old Misty Ann Holmes and charged the duo with possession of marijuana with intent to deliver and possession of drug paraphernalia. According to the police report, the couple returned to the home they share and found the home broken into and a quarter-pound of marijuana missing. They immediately called authorities to report the break-in and theft. Police said the couple told them they were going to resell the marijuana and allowed the detectives to search the apartment. Investigators discovered several marijuana stems among other drug paraphernalia during the search, The News Herald in Panama City reported for Saturday editions. They were taken to the Bay County Jail and are each being held on $17,500 bond. Copyright 2004 by The Associated Press. |

That's OK, I once had a client who called the police to report that his pot pipe and his cable TV "black box" were stolen. The box was actually the bigger problem - in this state it is actually a FELONY!!!! The cop even asked the guy if he was sure he wanted to report this - and the guy said yes. He had an idea who broke into his place, and he wanted them caught. He ended up with more legal hassles than they did. A few years back there was a guy (again in FL) who called police to report that a bag of cocaine was stolen from his hotel room. The police asked him to describe it, got a similar bag from their storage, asked the guy if it looked like his, asked if he wanted it back - and the guy took it back signed for it. The box was actually the bigger problem - in this state it is actually a FELONY!!!! Hmmm - drug paraphernalia (with no drugs) vs. theft of services. Which do you think is a bigger problem? Depends on how you define "bigger problem" IMO. Theft of services clearly harms the cable TV company by depriving them of revenue due for services provided. It's not clear that the couple with the marijuana was harming anyone. |

Their "estimate" assumed that the theft began the day they began servicing the area, and that the guy took every premium channel, a huge amount of pay per view per day, and every special event. The guy was TRYING to plead out - he admitted to both the pipe and the black box. He wasn't claiming he hadn't stolen additional services (he had a basic subscription), the main question was how much.
