I know there was talk about the House Committee making it, IDK if they actually did. The offer was on the table. Not sure what his lawyers position is. Think closed door hearing. Also, if they make the offer, can one then refuse the offer and still plead the fifth? I would think that once they give you immunity, then there is no potential self-incrimination any more and you'd have to testify or face contempt, no? Once immunity is offered, given and accepted, he must comply to tell the truth and nothing but the truth under Oath. A chance to save his ass. |

Unless facts prove otherwise. Ignorance of the law is not a defense. |

wrote: But the question was can he refuse to accept immunity and still plead the fifth, not testify, etc. Or if they grant immunity, does pleading the fifth go out the window. And the answer appears to be there is no "acceptance" required: http://muldoongetz.com/issue78.html "Under the Fifth Amendment to the Constitution, a person may not be compelled to testify against himself. The prosecution may require a witness to testify, but to do so, must first confer immunity upon the witness." "A witness who refuses to testify after being given immunity can be held in contempt of court and subjected to fines and jail time." Don't take my legal advice. From your link: "If it is known beforehand that a witness will refuse to testify based on self-incrimination grounds, may the witness be allowed to invoke the Fifth Amendment on the witness stand? It is within the trial court’s discretion whether or not to permit a party to place a witness on the stand and require assertion of self incrimination privilege in the jury’s presence. See People v Tatro, 53 AD3d 781 (3d Dept 2008)." Lois Lerner took the 5th, after she gave testimony. Call in sick is my advice. |

There are good reasons the presidency should not be going again to members of the same family, whether that's the Bushs or Clintons. And I thought the fact that the Bushs and the Clintons can't see that is one reason neither of them should be president. There are plenty of other qualified people in this country of 320 million. |
