Default Condo is not good. Can I move out?

writes:

Hello,

I purchased a condo about two months ago and my experience has not been
good. My golf clubs were stolen from my car in the parking lot, the
walls are paper thin, and planes fly overhead.

Hi Joseph,

Sorry to hear of your bad experience. It's no fun living in a noisy
place you don't feel safe. :-\ Was this new construction, or an
existing condo?

I thought I read somwhere that condo owners are protected for 90
days from purchase in case of a breach or something and can actually
back out of the deal. Is this true or am I imagining things?

Even if such a thing were true (never heard of it myself), you'd have
to demonstrate exactly what contractual obligations the seller has
breached. I'm not a lawyer, nor have I seen your closing documents,
but I can say it would be highly unusual for a seller to make any
warranties against planes flying overhead, responsibility for noises
from adjacent neighbors, or responsibility for theft from the parking
lot.

If you are interested in investigating options against the seller
however (and I suspect this would only be within the realm of
_possibility_ if you puchased this condo as new construction), you
need a real estate attorney to review your case.

Do I have any options or am I stuck here? I could sell but it would be
at a loss.

Best Regards,
