That should be "earnest" as in, "marked by or showing deep sincerity or
seriousness" -- not "Ernest" (someone's name).

I don't remember the specifics, but I vaguely recall that in our
contract, sending the report to the seller started a clock for him to
respond -- his response started a new clock for us to accept/decline his
offer -- etc. The earnest money's return to us was always
non-refundable if we backed out of the contract we signed.
