Since you ask.. he wasn't in Afganistan.

And what ever he was doing, there wasn't even enough evidence for your
'kangaroo court' military tribunal to try him, so your government
finally let him go; much to the discgust of the Austrailan Government
who are now desperately trying to cover their arses for not having
protected one of their citizens.
