Default Lanlord liable for tobacco smoke getting into my apt?

here. I guess some neighbor has moved in that smokes, and it's
getting in through the ventilation or through doors/windows that are
not properly/completely sealed.

I had this happen when the tenant below moved and another moved in. I
think the smoke was coming up through the pipes behind the sink. After
explaining the situtation to the landlord we terminated the lease and
I moved.
