There is indeed a provision in at least one of the versions of
the proposed health insurance law to this effect. The problem is
that no penalties such as fines or jail time are specified, thus
the only punishment for violation is to have someone wave their
fat finger at you while saying "bad boy -- bad boy."

The smarter idea is not to try to coerce compliance with punishment, it's to
design the system so it's extremely difficult to game it. That should be
simple enough, if there is a good ID and computerized checking system. A few
will always slip through but if the idea is to make the system work
financially, you only have to look to commercial credit card companies. They
don't go broke because of fraud.
