Yes. Depending on the state law, it may even be called attempted

The prosecutor just announced that no charges will be brought against the
officer. He still faces a departmental review. How long do they need to
do that review? Prosecutor finished his.

A bus transport supervisor (Lieutenant) had a crook spit on him. He
taped his mouth shut with duct tape.. The crook died and Gerrie went
to confinement. He worked as a 'trustee' in a county jail. No time
served in federal prison.
